Acceptance of Terms
Welcome to Ride the Bus ("we", "our", or "us"). By accessing or using our website, game, or related services (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must discontinue use of the Service.
These Terms apply to all users, including those connecting via wallets (e.g., MetaMask, Coinbase Wallet) and interacting with blockchain-based features.
Eligibility
To use the Service, you must be at least 18 years old (or the legal age in your country) and have the legal capacity to enter into a binding agreement. By using the Service, you confirm that you meet these eligibility requirements.
Wallet & Blockchain Interactions
- Wallet Use: To access certain parts of the Service, you must connect a compatible wallet (e.g., MetaMask, Coinbase Wallet).
- Responsibility: You are solely responsible for maintaining the security of your wallet and private keys. We do not store or have access to your keys. If you lose access to your wallet, we cannot recover your assets or NFTs.
- Blockchain Transactions: All transactions related to NFTs and in-game assets are recorded on a public blockchain, such as Ethereum, Solana, or another decentralized network. We do not control, modify, or reverse blockchain transactions.
- Gas Fees: You are responsible for paying any applicable blockchain network fees (e.g., gas fees) associated with transactions.
User Accounts
- Optional Accounts: While connecting a wallet may be sufficient to use our Service, some features may require you to create an account.
- Accuracy: You agree to provide accurate information when creating an account and to keep it up to date.
- Account Termination: We reserve the right to suspend or terminate your access to the Service if you violate these Terms or engage in prohibited activities.
Ownership & Intellectual Property
- Game Content: All text, graphics, images, videos, software, and other content related to Ride the Bus are owned by us or our licensors.
- NFTs & In-Game Assets: While you may own NFTs or in-game assets purchased or acquired through our Service, you do not own the underlying software, art, or intellectual property related to them unless explicitly stated. Ownership of NFTs does not grant you commercial rights to the artwork or assets, except as explicitly provided.
Prohibited Activities
You agree not to engage in any of the following activities:
- Illegal Use: Using the Service for any unlawful, fraudulent, or malicious purpose.
- Exploitation: Exploiting bugs, glitches, or vulnerabilities in the game or blockchain systems.
- Automated Use: Using bots, scripts, or automated tools to interact with the Service without our permission.
- Interference: Attempting to interfere with or disrupt the operation of the Service.
- Impersonation: Impersonating another person or entity or misrepresenting your affiliation.
In-Game Purchases and Payments
- Purchases: The Service may allow you to purchase NFTs, skins, or in-game assets using cryptocurrency or other forms of payment.
- No Refunds: Purchases made through blockchain transactions are final, irreversible, and non-refundable.
- Fees: You are responsible for any fees or costs associated with your transactions, including gas fees.
Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We make no guarantees about the availability, performance, or accuracy of the Service. Specifically, we do not guarantee:
- That the Service will be uninterrupted, error-free, or free from security issues.
- That NFTs, in-game assets, or rewards will retain their value or functionality.
- That the Service will remain operational, as it may be discontinued or modified at any time.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for:
- Loss of Assets: Loss of NFTs, tokens, or other blockchain-based assets due to wallet issues, technical failures, or errors.
- Service Downtime: Losses resulting from downtime, delays, or interruptions of the Service.
- Blockchain Risks: Risks related to blockchain networks, including changes to protocol rules (forks) or malicious actors.
- Indirect Damages: Indirect, incidental, special, or consequential damages.
If we are found to be liable for any damages, our total liability is limited to the amount you paid for access to the Service (if any) in the last 12 months.
Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, and expenses (including legal fees) arising out of:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property rights.
Changes to the Service
We may update, modify, or discontinue the Service at any time, without prior notice. This may include adding, removing, or changing features, game mechanics, or blockchain networks. We are not liable for any impact such changes may have on your in-game assets or NFTs.
Termination of Use
We reserve the right to suspend, terminate, or restrict your access to the Service at our discretion if you violate these Terms or engage in prohibited activities. Upon termination, you lose access to the Service but retain ownership of your NFTs and in-game assets stored in your wallet.
Dispute Resolution
If you have a dispute with us, we encourage you to contact us to resolve it informally. If a resolution cannot be reached, disputes will be resolved as follows:
- Arbitration: Any dispute will be resolved by binding arbitration, not in court, unless otherwise required by law.
- Location: The arbitration will take place remotely, as agreed by both parties.
- Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions.
Force Majeure
We are not responsible for delays or failures caused by events beyond our control, such as natural disasters, war, government actions, internet outages, or blockchain malfunctions.
Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you via the Service or through other communication channels. Your continued use of the Service after the changes go into effect signifies your acceptance of the updated Terms.
